• Refund any amount already paid for the unavailable product.

7. Placing an Order

Submitting an order through our online store constitutes an offer by you to purchase the selected products.

An automated order confirmation or acknowledgment generally confirms that we have received your order. It does not necessarily mean that the order has been finally accepted.

A binding purchase agreement will generally be formed when we:

If payment has already been collected for an order that we cancel, the applicable amount will be refunded using the original payment method or another appropriate method where necessary.

Any cancellation will not affect rights that cannot legally be excluded.

16. Returns and Refunds

Returns, exchanges, cancellations and refunds are governed by our Return and Refund Policy.

We currently provide a voluntary 30-day return policy for eligible products, subject to the conditions set out in that policy.

This commercial return arrangement is separate from statutory consumer rights.

17. EU/EEA 14-Day Right of Withdrawal

Consumers making eligible online or distance purchases in the European Union or European Economic Area may have a statutory right to withdraw from the purchase within 14 days without providing a reason, subject to applicable exceptions.

Where this statutory withdrawal right applies:

• The consumer must communicate the decision to withdraw before the applicable deadline;

• The goods must be returned within the applicable statutory period;

• The consumer may inspect the goods only to the extent reasonably necessary to determine their nature, characteristics and functioning; and

• The consumer may be responsible for the direct cost of returning the goods where this responsibility has been properly communicated in advance.

18. Defective, Damaged or Incorrect Products

Nothing in our voluntary return policy affects mandatory rights relating to:

• Defective products;

• Damaged products;

• Incorrect products;

• Missing components; or

• Products that do not conform to the purchase contract.

Where a return results from a confirmed defect, delivery damage, incorrect product or other error attributable to us, reasonable return costs will be handled in accordance with applicable law and our Return and Refund Policy.

19. Refunds

Approved refunds will generally be made through the original payment method unless:

• Another method is agreed;

• The original method cannot reasonably be used; or

• Applicable law requires another method.

Refund timing may depend on:

• The type of return;

• Payment method;

• Date the returned goods are received;

• Date acceptable proof of return is provided; and

• Processing times of the payment provider.

Where a statutory withdrawal right applies, reimbursement will be processed within the legally required period.

Where permitted by law, we may withhold reimbursement for physical goods until:

• Acceptable evidence of return has been provided,

whichever occurs first.

• Our licensors; or

• Other rights holders.

Except where permitted by law, you may not, without appropriate authorization:

• Remove intellectual property notices;

• Use it to mislead another person; or

• Use protected trademarks or branding without permission.

Nothing in these Terms transfers ownership of intellectual property to you.

Where the Services allow you to submit:

• Photographs;

• Videos;

• Suggestions;

• Feedback; or

• Other content,

you retain ownership of content that you lawfully own.

By submitting content through the Services, you grant us, to the extent permitted by law, a non-exclusive, worldwide, royalty-free license to use, reproduce, adapt, translate, publish and display that content for legitimate purposes including:

• Operating the Services;

• Displaying customer reviews;

• Promoting products;

• Improving our online store;

• Responding to feedback; and

You confirm that content submitted by you:

• Is owned by you or submitted with appropriate permission;

Our online store is hosted and supported by Shopify.

Shopify may provide technical services including:

Unless expressly stated otherwise, products offered through our online store are sold by Calculator v/Lone H la Cour, not Shopify.

Shopify is not automatically a party to the purchase agreement between you and Calculator v/Lone H la Cour.

Shopify may separately process certain personal information according to its own privacy documentation and applicable law.

25. Privacy

Personal information collected in connection with the Services is processed according to our Privacy Policy.

Our Privacy Policy explains matters including:

• How information may be shared;

• How information may be retained;

Because the online store is hosted through Shopify, Shopify and other service providers may also process information where necessary to provide their services.

26. Errors and Corrections

• Incorrect availability information;

• Incorrect delivery estimates; or

• Other inaccuracies.

We may correct inaccurate information when an error is identified.

Nothing in this section limits mandatory consumer rights.

We may use reasonable technical measures to prevent automated activity that creates security, privacy, operational or intellectual property risks.

29. Suspension and Termination

We may suspend or terminate access to all or part of the Services where reasonably necessary because:

• These Terms have been materially breached;

• Fraud or unlawful activity is reasonably suspected;

• A valid payment obligation remains unpaid;

• Website or account security has been threatened;

• An account presents a material risk to customers or third parties; or

• We are required to do so by law.

Where reasonably possible and legally appropriate, notice may be provided before suspension or termination.

Termination does not affect rights or obligations that arose before termination.

Provisions concerning matters such as:

• Privacy;

• Liability; and

• Disputes

may continue to apply after termination where appropriate.

30. Service Availability

We take reasonable steps to maintain the availability and security of the Services.

However, we cannot guarantee that the online store will always be:

Nothing in these Terms excludes or limits liability where it cannot legally be excluded or limited.

This includes, where applicable, liability for:

• Intentional misconduct;

• Death or personal injury caused by negligence;

• Gross negligence where liability cannot lawfully be restricted;

• Mandatory product liability;

• Violation of non-waivable consumer rights; or

To the extent permitted by law, you may be responsible for reasonable losses resulting directly from:

You will not be responsible for losses caused by our own breach, negligence or unlawful conduct.

33. Events Outside Our Reasonable Control

We will not be responsible for a failure or delay caused solely by events outside our reasonable control, subject to mandatory consumer law.

Such circumstances may include:

• Natural disasters;

• Extreme weather;

• War;

• Civil unrest;

• Government action;

• Epidemics;

• Strikes;

• Transportation disruption;

• Telecommunications failures;

• Power outages;

• Customs restrictions; or

• Major failures of third-party infrastructure.

Where such an event affects an order, we will take reasonable steps to reduce its impact.

Mandatory consumer rights remain unaffected.

34. Severability

If any provision of these Terms is found to be unlawful, invalid or unenforceable, that provision will apply to the maximum extent legally permitted.

Where necessary, the invalid or unenforceable portion will be separated from the remaining Terms.

The remaining provisions will continue in effect.

35. No Waiver

If we delay or fail to exercise a right under these Terms, this does not automatically mean that we have waived that right.

Any waiver applies only to the specific matter to which it relates.

36. Entire Agreement

These Terms, together with policies incorporated by reference, form the agreement governing your use of the Services and purchases made through the online store.

Such policies may include:

Nothing in this section excludes information or terms that legally form part of a consumer purchase contract.

If you are a consumer residing in another country, this choice of law does not deprive you of mandatory consumer protections that apply to you under the laws of your country of residence.

39. Dispute Resolution

• A refund;

• A return; or

• The Services,

we encourage customers to first attempt to resolve the matter directly with us.
